Halle Berry’s Lawyer Rejects Olivier Martinez Abuse Claims

Halle Berry’s attorney is forcefully disputing allegations made by the actress’s ex-husband, Olivier Martinez, after he obtained a temporary restraining order and asked the court for sole custody of their 12-year-old son, Maceo.

According to documents cited by People magazine and TMZ, Martinez accused Berry of physically and emotionally abusing their son. In his filing, he alleged that Berry caused him “emotional and mental distress due to physical abuse of our minor child, Maceo,” and claimed she “physically abused our son, Maceo, by jumping on him, putting her hands around his neck, and choking him.” He further alleged that a Sept. 26, 2026 incident was the latest in what he described as a pattern of abuse over the past several years.

Martinez also claimed there were other episodes involving what he described as additional physical attacks on Maceo, as well as verbal and emotional abuse directed at him. He alleged that Berry entered their son’s room, saw him using virtual reality goggles while playing a game, told him he looked “so stupid,” and then attacked and choked him while shouting, “Who is dominant now?!” Martinez said Maceo later called him and said Berry had attacked him. He also stated that Berry’s fiancé, Van Hunt, was at the home at the time.

Berry’s attorney, Marina Beck, rejected the accusations in a statement to Fox News Digital, calling the filing baseless. Beck said, “To say this filing is entirely meritless and deliberately misleading would be an understatement.” She added that there is “voluminous evidence,” including prior judicial rulings, showing Martinez repeatedly violated court orders and interfered with therapeutic and educational interventions for Maceo, conduct for which Beck said he has already been sanctioned.

Beck also said the latest filing was not surprising given what she described as Martinez’s “well-documented history of erratic, possessive and violent behavior.” She said Berry is saddened by the situation but remains focused on what she believes are her son’s best interests.

Current court restrictions and custody terms

Under the temporary restraining order, Berry must stay 100 yards away from Martinez. TMZ reported that she may only see Maceo during court-ordered visitation two days a week and every other weekend until an Oct. 16 hearing. The former couple have also been directed to attend confidential mediation regarding custody.

Martinez’s petition additionally asks that Berry not be under the influence during visits and that she undergo sobriety testing before, during and after time with their son. Representatives for Martinez did not immediately respond to Fox News Digital’s request for comment.

Background on the divorce and prior custody fight

Berry and Martinez finalized their divorce in 2023, eight years after their split. Court documents previously obtained by Fox News Digital showed Berry agreed to pay nearly $8,000 per month in child support. She also pays Martinez 4.3% of any income she earns above $2 million, while covering Maceo’s private school tuition, all extracurricular costs and his health care.

According to the divorce judgment, Martinez is required to take “reasonable action” to find employment and contribute financially for Maceo. Their current parenting arrangement allows Maceo to split time with both parents during the week and alternate weekends, with some holiday exceptions. He is also allowed one phone or video call with the other parent before bed, limited to less than 15 minutes. Both parents are barred from speaking negatively about each other in front of him.

The new restraining order petition comes two years after Berry sought sole custody, alleging Martinez’s “turbulent and detrimental behavior” disrupted educational and therapeutic interventions for their son and harmed Maceo’s relationship with her. Berry is also mother to 18-year-old Nahla Ariela Aubry, whom she shares with ex Gabriel Aubry.
